The Platform to Business Regulation (2019/1150) will come directly into force in the 27 EU member states and the UK from 12 July 2020. The Regulation will introduce a raft of new requirements that platforms and search engines will need to comply with in their dealings with business users who sell to consumers through their services including:
- mandatory provisions in ts&cs addressing a number of issues including grounds for termination, changes to terms, parameters that determine ranking and access to data;
- provide access to a complaint handling system; and
- appointment of two or more mediators that the platform/search engine is willing to use to resolve a dispute.
Marketplaces and search engines need to disclose the main parameters they use to rank goods and services on their site, to help sellers understand how to optimise their presence. The rules aim to help sellers without allowing gaming of the ranking system.
