On November 11, 2020, the Swiss Federal Council opened a consultation procedure for the amendment of the Federal Act against Unfair Competition (UCA). A new provision in the UCA is intended to prohibit the use of fixed price clauses in contracts between online booking platforms and accommodation providers. The prohibition of price fixing clauses shall be anchored in a new article 8a UCA. The new regulation in the UCA is intended to achieve that hotels and other players in the hospitality industry remain free in their pricing. The ban allows them to promote direct sales via own websites and thus strengthen the competition. The consultation phase - which allows all stakeholders and interested parties to comment on the proposal - ends 26 February 2021; thereafter, discussions in parliament will continue.
