On 23 December 2020, the National Privacy Commission issued NPC Circular No. 2020-03 on data sharing agreements.  

The Circular lays down the general principles of and key considerations to data sharing (which is defined as sharing, disclosure or transfer of personal data under the custody of a personal information controller to one or more other personal information controller/s).  It also prescribes the contents of a compliant data sharing agreement under local laws and regulations.  

The Circular, which applies to personal information controllers in both the public and the private sectors, supersedes the earlier NPC Circular No. 16-02 on data sharing agreements meant for government agencies only.  It will take effect 15 days from its publication in the Official Gazette or two newspapers of general circulation.
