Online booking platforms often contractually restrict the freedom of accommodation providers to set their own prices and conditions for the accommodation offered. While the use of so-called wide price parity clauses is already prohibited in Switzerland since 2015, a newly adopted amendment to the Swiss Act against Unfair Competition will now further restrict the contractual freedom of online booking platforms by prohibiting the use of general terms and conditions that directly or indirectly restrict the pricing and supply of accommodation providers through price, availability or condition parity clauses.
